Terms of Service

1. Acceptance of Terms

By accessing or using the Tails Australia Pty Ltd ("Tails") mobile application or website ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

2. Nature of the Platform (Connection Service Only)

Tails is an Australian online platform that provides a connection and communication service between independent users, including Breeders and Buyers.

For the purpose of these Terms:

  • "Breeders" means users who list or advertise animals on the Platform
  • "Buyers" means users who browse, enquire about, or acquire animals

Tails does not:

  • sell, adopt, broker, or transfer pets;
  • facilitate or process payments for the sale, adoption, brokerage or transfer of pets;
  • act as an agent, representative, or intermediary; or
  • participate in negotiations or agreements between users.

All agreements and transactions must occur entirely outside the Platform and remain the sole responsibility of the users involved.

Users must conduct their own due diligence, including (but not limited to):

  • verifying the identity of other users;
  • assessing the condition and welfare of animals;
  • confirming breeder credentials; and
  • evaluating transfer or purchase arrangements.

Tails accepts no responsibility or liability for:

  • failure of users to undertake due diligence; or
  • any transactions or agreements entered into between users.

3. User Accounts

By creating an account, you agree that:

  • you are at least 18 years old;
  • you will provide accurate and current information and keep it updated; and
  • you are responsible for all activity under your account.

Breeders must verify their email before listing pets on the Platform. Email verification confirms ownership of an email address only and does not constitute identity verification or background checks.

Tails may suspend or terminate accounts at its sole discretion where risks, fraud, or policy violations are suspected. No refunds will be provided for suspended or terminated accounts.

4. Pet Listings

4.1 Breeder Acknowledgement

Breeders acknowledge and agree that:

  • all listing information is self-declared (including, but not limited to, personal information and pet information);
  • they are solely responsible for the accuracy of all listings; and
  • any registrations (e.g. MDBA, RPBA, ANKC, councils) are claims made by the Breeder.

Tails does not guarantee the accuracy, legitimacy, legality, or ethics of any listing.

4.2 Buyer Acknowledgement

Buyers acknowledge and agree that:

  • all listing information is provided by Breeders and is not independently verified by Tails, except to the extent described in clause 5;
  • Breeders are solely responsible for the accuracy of listings;
  • Tails does not accept liability for inaccurate or misleading listings;
  • Tails does not guarantee the legitimacy, legality, or ethics of any listing; and
  • Buyers must conduct their own due diligence before interacting with or entering into any agreement with Breeders or other users.

4.3 Waiver

To the maximum extent permitted by law, users waive any claim against Tails arising from:

  • reliance on listing information;
  • interactions with other users; or
  • any transaction or agreement entered into with another user.

5. Tails Reviewed Badge

5.1 Overview

Tails may offer an optional review program known as "Tails Reviewed." Breeders who voluntarily submit documentation may, at the sole discretion of Tails, be granted a Tails Reviewed badge.

5.2 Eligibility for Tails Reviewed

Breeders may be considered for the Tails Reviewed program where they provide information and documentation reasonably requested by Tails, which may include:

  • breeder identity and contact details, including name, email, phone number, and state of operation;
  • breeder registration details (where applicable), including registration body and identification or source numbers;
  • veterinary documentation relating to a recent litter or breeding activity (for example, vaccination records, microchip records, or veterinary health checks);
  • details of a nominated veterinary clinic, including clinic name and contact information;
  • photos or videos of the breeding environment, including evidence of the animals and living conditions; and
  • declarations confirming the accuracy, authenticity, and compliance of the information provided.

Tails may specify requirements for such materials, including that documentation must:

  • be recent;
  • clearly identify the issuing veterinary clinic;
  • include visible dates; and
  • be legible and unaltered.

Tails may also require breeders to consent to Tails contacting nominated third parties (including veterinary clinics) for the limited purpose of confirming information provided.

The above requirements are indicative only. Tails may, at its sole discretion:

  • request additional information or documentation;
  • accept partial submissions; or
  • determine that the information provided is insufficient for approval.

5.3 Nature of the Review

The Tails Reviewed process is a limited, point-in-time administrative review conducted by Tails based on information provided by the breeder.

Tails Reviewed includes review of veterinary documentation relating to one recent litter (typically within the last 6–12 months), provided by the breeder as part of the application.

This review may include:

  • identity and contact detail confirmation;
  • review of breeder registration (if provided);
  • review of veterinary documentation (if provided);
  • confirmation of a nominated veterinary clinic (where possible); and
  • review of photos or videos of breeding environments.

5.4 Reliance on Provided Information

Users acknowledge that:

  • all review outcomes are based on breeder-submitted information;
  • Tails does not independently verify all information and may not verify any information in certain cases; and
  • Tails may rely on third-party information (including veterinary clinics).

Where:

  • information cannot be verified;
  • third parties cannot be contacted; or
  • documents are incomplete or unclear,

Tails may:

  • request further information;
  • proceed with a limited or incomplete review; or
  • decline the application.

5.5 No Guarantees or Endorsement

The Tails Reviewed badge:

  • reflects completion of a review at a specific point in time only;
  • applies to the breeder profile only and does not assess or verify individual animals listed on the Platform;
  • does not guarantee ongoing conduct or compliance;
  • does not guarantee animal health, welfare, genetics, or legality; and
  • does not constitute certification, licensing, endorsement, or recommendation.

5.6 No Ongoing Monitoring

Tails does not conduct ongoing monitoring of breeders after a review is completed.

5.7 User Responsibility

Users must not rely solely on the badge and must conduct their own independent due diligence.

5.8 Platform Discretion

Tails may at any time:

  • grant, refuse, suspend, or remove a badge;
  • request updated documentation;
  • revoke status if concerns arise.

From approval, the Tails Reviewed badge will remain active until the earlier of:

  • the expiry of the Breeder's Gold subscription; or
  • 12 months.

For the avoidance of doubt, a Gold subscription will expire once the Breeder has cancelled it, meaning that approval will roll over on a month-to-month basis should the monthly subscription model be used.

5.9 Program Changes

Tails may modify, suspend, or discontinue the Tails Reviewed program at any time without notice.

6. Verification Limitations

To the maximum extent permitted by law:

  • Tails has no obligation or duty to investigate or verify user information;
  • verification processes are administrative only;
  • Tails is not responsible for errors, omissions, or missed misconduct;
  • Tails is not liable for reliance on any badge or verification status.

7. Buyer Responsibilities

Buyers must:

  • conduct independent research;
  • verify breeder credentials;
  • inspect pets where possible;
  • seek professional advice where appropriate.

Tails does not guarantee pet health, temperament, or suitability.

8. No Endorsement

No listing, badge, ranking, or visibility constitutes endorsement by Tails. Paid features do not indicate quality or legitimacy.

9. Content Authenticity

Users must ensure:

  • media depicts real animals;
  • no AI-generated or manipulated content is used;
  • information is accurate and not misleading.

Tails may remove suspicious content.

10. Prohibited Conduct

Users must not:

  • provide false or misleading information;
  • upload fake or AI-generated listings;
  • engage in illegal breeding or activity;
  • scam or deceive users;
  • create fake or duplicate accounts.

11. Platform Moderation

Tails may, at its sole discretion and without notice, remove content, suspend or terminate accounts, or restrict access to the Platform.

12. No Liability for User Conduct

Tails is not liable for:

  • user misrepresentation;
  • breeder conduct;
  • pet health or condition;
  • disputes between users;
  • financial loss, emotional distress, or injury.

Users interact at their own risk.

13. Disclaimer of Warranties

The Platform is provided "as is" and "as available." Tails makes no warranties regarding accuracy, reliability, or outcomes.

14. Informational Content

All guides and content are general information only and not professional advice.

15. Limitation of Liability

To the maximum extent permitted by law, Tails' total liability is limited to AUD $100.

Nothing in this clause excludes, restricts, or modifies any right, remedy, guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted, or modified.

16. Indemnification

You agree to indemnify Tails against claims arising from:

  • your content;
  • your conduct;
  • your transactions;
  • your breach of these Terms.

17. Privacy

Use of the Platform is subject to the Tails Privacy Policy.

18. Termination

Tails may terminate accounts at any time. Access ceases immediately upon termination.

19. Governing Law

These Terms are governed by the laws of Victoria, Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts, and waives any right to object to proceedings being brought in those courts.

21. Intellectual Property and User Content Licence

21.1 Ownership of Platform

All intellectual property rights in the Platform, including software, design, text, graphics, logos, and trade marks, are owned by or licensed to Tails. Nothing in these Terms transfers ownership of any Platform intellectual property rights to you.

21.2 User Content Licence

By uploading, submitting, or publishing content on the Platform (including photos, videos, text descriptions, and breeder profiles) ("User Content"), you grant Tails a non-exclusive, royalty-free, worldwide, sublicensable licence to store, display, reproduce, and distribute your User Content solely for the purposes of operating and improving the Platform.

21.3 Your Representations

You represent and warrant that:

  • you own or have the necessary rights to all User Content you submit;
  • your User Content does not infringe any third-party intellectual property rights, privacy rights, or applicable law; and
  • Tails' use of your User Content as permitted by these Terms will not infringe the rights of any third party.

21.4 Moral Rights

To the extent permitted by law, you consent to Tails exercising acts that would otherwise infringe your moral rights in User Content.

22. Dispute Resolution

22.1 Informal Resolution

Before commencing any legal proceedings, a party must give written notice to the other party describing the dispute and the outcome sought, and the parties must then use reasonable efforts to resolve the dispute through direct negotiation within 30 days of that notice (or such longer period as agreed).

22.2 Formal Proceedings

If the dispute is not resolved within the period in clause 22.1, either party may commence formal legal proceedings in accordance with clause 19.

22.3 Urgent Relief

Nothing in this clause prevents a party from seeking urgent interlocutory or injunctive relief from a court.

23. Force Majeure

Tails is not liable for any failure or delay in performing its obligations under these Terms to the extent caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, telecommunications failure, denial-of-service attacks, government action, or interruption of third-party services. Tails will use reasonable efforts to minimise the impact of such events and to resume performance as soon as practicable.

24. Severability and Entire Agreement

24.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

24.2 Entire Agreement

These Terms (together with the Privacy Policy and any additional terms applicable to specific features) constitute the entire agreement between you and Tails with respect to the Platform and supersede all prior representations, negotiations, understandings, and agreements, whether written or oral.

25. Assignment

You may not assign, transfer, or sub-licence any of your rights or obligations under these Terms without Tails' prior written consent. Tails may assign or transfer its rights and obligations under these Terms to a related entity or successor in connection with a merger, acquisition, corporate restructure, or sale of assets, without your consent, provided that Tails gives you reasonable notice of any such assignment.

26. Tails Tag (Additional Product Terms)

26.1 Application of This Clause

This clause applies to the Tails Tag product and related services ("Tails Tag"). By purchasing, activating, or using a Tails Tag, you agree to be bound by this clause in addition to the rest of these Terms. To the extent of any inconsistency between this clause and other parts of these Terms, this clause prevails in relation to the Tails Tag.

26.2 Nature of Tails Tag

The Tails Tag is a separate product offering from the Platform and is not required to use the Tails marketplace. The Tails Tag is a QR/NFC-based pet identification product that enables linking a physical tag to a digital pet profile, scan-based notifications, and optional location-related alerts where available.

26.3 Product Description

The Tails Tag is sold as a one-time purchase and includes:

  • one physical QR/NFC tag;
  • access to create and manage a pet profile; and
  • scan notifications, including SMS alerts where enabled.

"Ongoing access" means continued access to the digital pet profile and associated features for as long as the Tails Tag service remains operational. Tails may modify or discontinue the service at any time in accordance with clause 26.8 (Discontinuation). The term "lifetime" does not imply perpetual access.

26.4 Activation and User Responsibilities

You are responsible for:

  • activating the tag prior to use;
  • maintaining accurate and up-to-date contact information;
  • ensuring the tag is securely attached to your pet; and
  • maintaining accurate pet profile details.

Failure to do so may impact the effectiveness of the product.

26.5 SMS and Notifications

By providing your phone number, you consent to receiving transactional SMS communications, including:

  • scan alerts;
  • lost pet notifications; and
  • service-related updates.

You may withdraw SMS consent at any time. Tails does not guarantee delivery, timeliness, or reliability of SMS notifications.

26.6 Location Data

Location data:

  • depends on third-party device permissions;
  • may not always be available; and
  • may be inaccurate or delayed.

Tails makes no guarantees regarding the accuracy or availability of location data.

26.7 Service Availability

The Tails Tag service relies on third-party systems, including:

  • telecommunications networks;
  • hosting infrastructure; and
  • SMS providers.

Tails does not guarantee uninterrupted or error-free service and may modify or discontinue features at any time.

26.8 Discontinuation

Tails may suspend or discontinue the Tails Tag service at any time. If discontinued:

  • scan notifications may cease; and
  • pet profiles may be removed.

No refunds will be provided beyond rights under the Australian Consumer Law. Users remain responsible for maintaining alternative pet identification methods.

26.9 Transfers

Tails Tags are linked to user accounts and must be reassigned through the Platform if ownership changes. Tails is not responsible for issues arising from transfers not conducted via the method prescribed by Tails on the relevant webpage.

26.10 Australian Consumer Law

Nothing in these Terms excludes rights under the Australian Consumer Law. Where required, remedies may include:

  • repair;
  • replacement; or
  • refund.

26.11 Disclaimer

The Tails Tag assists in pet identification but does not guarantee:

  • a lost pet will be found;
  • a tag will be scanned;
  • a finder will make contact; or
  • the service will operate continuously.

You remain responsible for your pet's safety.

26.12 Limitation of Liability

To the extent permitted by law, liability relating to the Tails Tag is limited to:

  • replacement;
  • repair; or
  • the cost of replacement.

Tails is not liable for indirect or consequential loss, including loss of a pet or emotional distress, except where required by law.

26.13 Relationship with Platform

The Tails Tag operates independently from the Tails marketplace. Use of the Tails Tag does not:

  • verify a breeder;
  • verify a user; or
  • relate to the Tails Reviewed program.
